Illness in the Dominican Republic – Your Rights

Your tour operator or holiday company accepts responsibility for all the services that make up your holiday, when your holiday is a package.

Consequently, if you are ill on holiday or a member of your family is taken sick at your hotel because of Food Poisoning, such as Salmonella or water poisoning, due to a contaminated swimming pool, your tour operator is liable to pay you compensation.

Dominican Republic holiday illness claims can be pursued under the Package Travel Regulations 1992, if the holiday was booked as a package (i.e. flights and accommodation).

Compensation claims can be pursued at any time within 3 years of the date the illness started, in the cases of adults, and in the case of children, 3 years from the date the child reaches the age of 18 years. Court proceedings must be commenced within these timeframes otherwise any claim is likely to be time barred.
